Abstract
The problem of sexual violence in the higher education environment is increasingly worrying. Therefore, the Ministry of Education and Culture issued the Regulation Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence. The regulation subsequently generated controversy within society. What precisely does the phrase "without the victim's consent" mean? Given that it qualifies as a crime, what category do articles that use the phrase "without the consent of the victim" fall into? We must address this issue to resolve the conflicting benefits and drawbacks in society, especially as the number of victims of sexual violence continues to rise. The author attempts to investigate this issue through the lens of normative legal research. The study employs phenomenological research methods to shed light on the occurrence of a system of power relationships within an educational setting that combats sexual violence. Next, the method will delve into the personal experiences of informants identified by the research participants within a higher education environment, examining how individuals construct and interpret their actions in a specific situation. The author believes that including the phrase "without the victim's consent" is necessary to protect the victim's privacy and individual rights. Articles containing the phrase "without the victim's consent" are not articles legalizing adultery, but articles with the qualifications for complaint offenses.
